In the brochure and on the website, ME offers to broker third-party services, namely contracts with the landlords of the vacation homes. ME therefore merely acts as an intermediary between the customer and the landlord. This does not apply insofar as ME, in accordance with , gives the impression of providing contractually agreed services relating to the vacation home as its own at in accordance with the principles of Section 651a (2) BGB.

The rights and obligations of ME as an agent arise from these agency terms and conditions, any supplementary contractual agreements, alternatively from the statutory provisions of Sections 675, 631 et seq. BGB (provisions on the provision of services for consideration).

Insofar as the following provisions contain regulations regarding the stay and the rights and obligations of the customer and landlord , these agreements are made by ME as a representative in the name and on behalf of the landlord and form part of the contract concluded with the landlord through mediation by ME

2.1 The following applies to bookings made verbally, by telephone, in writing, by e-mail or by fax:

b) The rental contract with the landlord comes into effect upon receipt of the booking confirmation (declaration of acceptance), which ME makes in its capacity as agent and representative of the landlord. The booking confirmation does not require any particular form, with the result that verbal and telephone confirmations are also legally binding for the customer. In the case of verbal or telephone bookings, ME shall send a written copy of the booking confirmation to the customer. However, verbal or telephone bookings made by the customer shall also lead to a legally binding booking confirmation in the event of a corresponding binding verbal or telephone confirmation.

Makarska Exklusiv agency conditions 2.2 For bookings that are made without individual communication via an online booking procedure (contract in electronic business transactions), in particular via the Internet, the following applies to the conclusion of the contract:

a) The online booking process is explained to the customer on the corresponding ME website. The customer has the option of correcting his entries, deleting or resetting the entire online booking form, the use of which is explained. The contract languages offered for the online booking are indicated. If the text of the contract is stored by ME in the online booking system, the customer shall be informed about this storage and the possibility of retrieving the text of the contract at a later date.

b) By clicking on the "Book with obligation to pay" button (the button), the customer makes a binding offer to the landlord to conclude the rental agreement with ME as the landlord's representative. The receipt of the booking shall be confirmed to the traveler electronically without delay.

c) The transmission of the contract offer by clicking the "Book with obligation to pay" button does not constitute a claim by the customer to the conclusion of the rental contract in accordance with their booking details. Rather, the landlord or ME as their representative are free to decide whether or not to accept the customer's contract offer.

d) The contract is concluded upon receipt of the booking confirmation from ME by the customer.

e) If the booking confirmation is made immediately after the customer has made the booking by clicking on the "Book with obligation to pay" button by displaying the booking confirmation on the screen (booking in real time), the rental agreement with the landlord is concluded upon receipt and display of this booking confirmation on the customer's screen, without the need for an interim notification of receipt of his booking. In this case, the customer is offered the option of saving and printing the booking confirmation. However, the binding nature of the rental agreement with the landlord is not dependent on the customer actually making use of these options for saving or printing. ME will also send the customer a copy of the booking confirmation by email, email attachment, post or fax.

2.3 ME points out that according to the statutory provisions (Section 312g (2) sentence 1 no. 9 BGB) - even if German law could be applicable to the contractual relationship between the customer and the lessor - and even if this is done by means of distance selling, there is no right of withdrawal. The customer's other statutory rights of withdrawal and termination remain unaffected.
